By accessing or using Backgroundless ("the Service") at backgroundless.io, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Backgroundless provides a free, AI-powered background removal and image editing tool. All image processing is performed entirely within your web browser using client-side technology. We do not upload, store, or access your images on our servers. The Service includes background removal, background replacement, and text overlay features.

3. Backgroundless Pro (One-Time Purchase)

Backgroundless Pro is an optional, one-time paid upgrade that unlocks additional seller workflow features. Pro is not a subscription and does not renew. Purchases are processed by Lemon Squeezy, acting as merchant of record; your payment details are handled by Lemon Squeezy and never reach us.

After purchase you receive a license key by email. The key activates Pro on a limited number of devices; you can deactivate a device at any time to free an activation slot.
License keys are personal and may not be resold or shared publicly. We may disable keys that are abused or obtained fraudulently.
Pro features run client-side like the rest of the Service. Validating your license key with Lemon Squeezy is the only network request Pro adds.
Refunds are handled through Lemon Squeezy in line with the refund policy shown at checkout. Contact us and we will help resolve any purchase issue.

4. User Responsibilities

You agree to use the Service only for lawful purposes. You are responsible for ensuring that:

You have the right to use and edit any images you process through the Service
Your use does not violate any applicable laws or regulations
You do not use the Service to process inappropriate, illegal, or harmful content
You do not attempt to reverse engineer, decompile, or disassemble the Service

5. Intellectual Property

Your content: You retain all rights to the images you process using the Service. We do not claim any ownership over your images or the processed results.

Our content: The Backgroundless website, its design, code, branding, blog content, and all related materials are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

The Service will be uninterrupted, error-free, or secure
The results of image processing will meet your specific requirements
Any defects in the Service will be corrected

Processing quality may vary depending on your browser, device capabilities, and the complexity of the images being processed.

7. Limitation of Liability

To the fullest extent permitted by law, Backgroundless and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, without limitation, damages for loss of data, profits, or business opportunities.

8. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the Service shall be resolved through good-faith negotiation.
